A new startup called Hiptype wants to bring all the analytics data that has become standard on the Web to the world of e-books. Hiptype's co-founders, James Levy (CEO) and Sohail Prasad (CTO), describe the product as "Google Analytics for e-books." They say they were collaborating on an e-book of their own about big data, and they were surprised to find that the information available via the big e-book stores is limited to download numbers/sales, user ratings, and reviews. Of course, there are many good treatments for cancer these days and he may live a very long time or even be cured, so while it is good to think about the future and plan, don?t count him out yet.
Generally, his family should talk to someone at the hospital or through the doctors office to find local support groups and places that can help them deal with the issues they face, including planning for their finances if he passes away. A bitter GOP primary contest in Texas for a U.S. Senate seat has come to this: an ad featuring a grieving mother who links one of the candidates to her son?s suicide.
A Texas super PAC is airing a TV ad that features a distraught mother who says Ted Cruz, a lawyer, ?should be absolutely ashamed of himself? for representing a key figure in Pennsylvania?s infamous ?kids for cash? scandal. In that case, two judges were convicted of taking $2.1 million from Cruz?s client in exchange for sending kids to private juvenile detention centers ? which were built by Cruz?s client. The woman?s son was among the kids sentenced to prison by one of the disgraced judges. Her son later shot himself to death.
The woman?s story is heart wrenching and the scandal is beyond awful. But Cruz had nothing to do with the criminal case. Cruz represented the prison builder in a related civil suit brought against his client by an insurance company. The ad falsely claims that Cruz argued that his client ?should not have to pay? for his role in a bribery scandal, when in fact his client had already agreed to pay $17.75 million in restitution to the victims, and would in fact have paid more if Cruz succeeded in his only role: getting the insurance company to kick in additional sums.
Big Race in Texas
The boast that ?everything is bigger in Texas? certainly applies to the state?s race for the Republican Senate nomination ? the most expensive race in the country. Nine candidates competed in the May primary and the two survivors ? Lt. Gov. David Dewhurst (45 percent) and Cruz (34 percent) ? are facing off in a runoff election on July 31.
The winner likely will be the state?s next U.S. senator, replacing the retiring Republican Sen. Kay Bailey Hutchison, so the GOP primary has been hotly contested ? to say the least.
Dewhurst alone has spent nearly $20 million ? more than twice as much as Cruz. Dewhurst also has benefited from a super PAC, the Texas Conservatives Fund, that is headed by one of his longtime aides, Rob Johnson. The fund has spent $2.5 million as of July 11 ? not including its latest TV ad, ?Ted Cruz Should Be Ashamed,? which was released July 23.
In the ad, Sandy Fonzo speaks about the ?kids for cash? scandal in Pennsylvania. In that case, two state judges,?Michael Conahan and?Mark Ciavarella?Jr., were convicting of taking more than $2.6 million in exchange for sending juveniles to for-profit detention centers.
Fonzo?s 17-year-old son, Edward Kenzakoski, was sentenced to prison by Ciavarella for what the Associated Press described as a ?minor drug paraphernalia charge.? Fonzo said her son later killed himself, and she blames Ciavarella.
The case is complicated, and the TV ad is confusing and disjointed ? in part because of the choppy editing of Fonzo?s interview, which deals with two separated but related cases.
A Criminal Scandal and An Insurance Dispute
The ad opens with Fonzo saying, ?Corrupt judges put my son in a for-profit juvenile detention center ? to make millions of dollars.? That?s clear enough, and accurate.
But then she says, ?Ted Cruz says his client should not have to pay, that the IRS is the victim, and not the kids here.? The accompanying text on the screen says, ?Ted Cruz?s client paid judges to put kids in jails he built.? Here, the ad is not talking about the criminal case against the judges ? and those who paid them ? but rather a related civil suit.
Cruz?s client was Robert Mericle, owner of Mericle Construction, who built two new for-profit prisons in Pennsylvania. Mericle testified that he gave the two judges payments totaling about $2.1 million. The owner of the facilities, Robert Powell, testified that he gave the judges an additional $600,000. The former judges argued in court that the payments were ?finder?s fees? for helping put Powell, owner of the facilities, in touch with Mericle, who built them.
Mericle accepted a plea agreement and testified on behalf of the prosecution. He pleaded guilty to failing to report a felony and is awaiting sentencing.
Cruz had nothing to do with the criminal charges against Mericle.
The young victims of the kids-for-cash scandal sued Mericle for civil damages. Mericle settled the case by agreeing in December 2011 to create a $17.75 million fund for the victims. The agreement (page 11) also says that Mericle will pay an additional $1.75 million into the fund ? if he wins his appeal of a lower court finding that his insurance company, Travelers Property and Casualty, did not have to pay for the victims? claims against Mericle.
Here?s where Cruz comes in. Cruz represented Mericle in the appeals case of the insurance dispute. On June 20, 2012, the U.S. Third Circuit Court of Appeals ruled against Mericle.
Now, let?s go back to Fonzo?s statement: ?Ted Cruz says his client should not have to pay, that the IRS is the victim, and not the kids here.?
It?s true that Cruz, while arguing the insurance case, said (at the 4:30 minute mark): ?The victim of that crime was the IRS, it was the federal treasury. It wasn?t the kids.? But Cruz was talking about the crime to which Mericle pleaded guilty. As the U.S. Attorney?s office explains, Mericle was charged with (and ultimately pleaded guilty to) failing to report the ?commission of a felony, a conspiracy between Michael T. Conahan and Mark A. Ciavarella, Jr. to defraud the United States of income tax due and owing for tax years 2003 and 2005 through 2007.?
Also, confused viewers may be left with the impression that Cruz was trying to help Mericle shortchange victims when Fonzo says, ?Ted Cruz says his client should not have to pay.? That?s misleading. As we explained earlier, the victims and their families ? presumably including Fonzo ? would have benefited if Cruz won the insurance dispute for his client. The $17.75 million victims? fund could have gained an additional $1.75 million, as stated in a press release issued by a law firm involved in the settlement when it was announced.
One last thing: The editing of Fonzo?s interview makes it impossible to know what she means when she says, ?That?s what my son?s life was worth, $500,? or whether she is blaming Cruz for such meager compensation. Rob Johnson, the executive director of the Texas Conservatives Fund, did not return a phone call. We also tried to reach Fonzo without any luck.
It is possible that Fonzo is talking about how much her family is entitled to under the agreement reached between Cruz?s client (Mericle) and the victims. The Scranton Times-Tribune reported on Feb. 29 that a state judge approved the agreement and that it would pay juveniles sentenced by the two judges between $500 and $8,200. But Fonzo said her son served time in prison, and those children would receive at least $5,000 if they were imprisoned in one of the new prisons built by Mericle and at least $1,000 if imprisoned in another facility.
In either case, Cruz had nothing to do with the creation of the fund or how much it pays victims. He was not one of the attorneys listed on the agreement. If anything, Cruz?s only involvement in the case would have resulted in more ? not less ? money for victims.

LOS ANGELES (AP) ? Veteran actress Lupe Ontiveros, who appeared in scores of TV shows and movies including "Desperate Housewives," ''Selena" and "As Good As It Gets," has died. She was 69.
Ontiveros died Thursday at a hospital in Whittier, Calif., a suburb southeast of Los Angeles, after a brief battle with liver cancer, according to longtime friend and family spokesman Jerry Velasco.
She was perhaps best known for her role in "Selena," the 1997 biopic based on the life story of the Tejano pop star. Ontiveros played Yolanda Saldivar, who in real-life was convicted of killing Selena Quintanilla. The film launched the career of Jennifer Lopez, who played the title part.
But that was only one of many roles. Ontiveros worked steadily in TV and film for more than 35 years.
"I want to go from the set to the grave," she quipped in 2010 while receiving a lifetime achievement award from the National Association of Latino Independent Producers. "From the stage to the grave, that's how I want go."
Her credits include "Real Women Have Curves," TV's "Desperate Housewives" and ? as in "The Goonies" ? many, many turns as a housekeeper. She once estimated she played a maid more than 300 times on the stage and screen.
"I've had a hell of a good time playing those maids," she told LA Weekly in 2002. "Each one to me is very special ... No matter how much I resent the stupidity that is written into them, the audacity that the industry has when they portray us in such a nonsensical, idiotic, such ? oh my God! ? such a degrading manner, still, my humor survives in these maids. I'm very proud of them."
Born Guadalupe Moreno in El Paso, Texas, on Sept. 17, 1942, Ontiveros caught the acting bug in 1972 when she answered a newspaper ad for movie extras. She went on to help establish the Latino Theater Company in Los Angeles and advocated for Latino performers throughout her career.
"She worked tirelessly to perfect her craft and open doors for countless Latinos along the way," said Alex Nogales, president of the National Hispanic Media Coalition. "Hollywood never gave her the lead role, but in our hearts she will be remembered as our leading lady. She will be deeply missed by all of us."
Ontiveros is survived by her husband, three sons and two granddaughters.

Giffords, who still uses a wheelchair much of the time, was on her first trip outside the United States since she was shot in the head by a gunman in January 2011 as she met local people outside a Tucson supermarket.
She rode the two-stage cable car to a station with spectacular views of Mont Blanc and other peaks in France, Italy and Switzerland.
In bright sunshine but sub-zero temperatures at an altitude of 3,842 meters (12,605 feet) at the cable-car station on the Aiguille du Midi peak, Giffords smiled as she stood with her husband's arm around her shoulders.
"Gaby is really enjoying this visit," Kelly told friends and reporters. "This is a great day for us."
Kelly, accompanied by other U.S. astronauts, then visited a nearby mountain research station to install a plaque recalling the last U.S. space shuttle mission.
The trip was organized by Chamonix Tourist Office and the European Nuclear Research Centre, CERN, in Geneva, where the AMS particle detector, which Kelly and his Endeavour team took to the International Space Station in May 2011, was developed.
Giffords was a Democratic member of the House of Representatives but resigned her seat this January, saying her district deserved to have a representative "who can give 100 per cent to the job."
Six people were killed in last year's shooting, which was thought to have been an attempt to assassinate Giffords. She is undergoing intensive therapy and her speech is impaired.?

The Chancellor must stop making excuses for the continuing downturn and take steps to stimulate the economy now?
Today?s GDP figures show that in the second quarter of 2012 the economy shrunk by 0.7 per cent. Taken together with the poor economic performance of the previous six months, and the stagnation of the last year, this means that our economy is now smaller than it was when the government took office.
In early 2008, when we first entered recession ? a result of global financial meltdown ? our economy was more than four per cent larger than it is today. Even before today?s dreadful statistics this was the slowest recovery in a century. Adjectives barely exist to describe the economic debacle of a double-dip recession that has now lasted nine months.
The last few years have brought a range of excuses for our economic difficulties. First it was the snow, then the sun, the Royal Wedding and the Jubilee. But without significant underlying economic weakness none of these factors would have had so much sway over our economic fortunes.
In the decade before the financial crash we managed to grow our economy pretty successfully despite variations in our weather patterns. In fact, the stream of recent excuses has more in common with the narratives of governments of the Great Depression than with any recent analysis of what determines economic performance.
The Chancellor continues to claim that we have no alternative to fiscal austerity; that without such rapid and sharp spending cuts the costs of our debt will become unsustainable, leading interest rates to rise and creating an even worse economic scenario. His analysis has always been that there is no viable economic alternative.
But we now have fresh evidence (which international examples have always provided) that there is. Despite economic catastrophe we can still borrow at record lows ? the costs of our debt are a consequence of the damaging impact that our economic quagmire is having on wider investor confidence, not a vindication of the government?s approach.
While government services are still making a small positive contribution to growth, it?s one that is declining ? and at this point in a slump should be far greater. And the significant cuts in public investment that are already underway are clearly making themselves felt on construction output, with dramatic drops in output responsible for more than half of today?s overall economic contraction. We are in desperate need of a fiscal stimulus to give us a demand injection that will restore growth, yet we have a government that is failing to see sense.
The Chancellor?s plan was developed when growth forecasts for 2012 were 28 times stronger than is currently the case (and today?s data mean they are only likely to get worse). It absolutely has to be time for a new approach. If we invest now in the infrastructure and job programmes that will help us build a stronger economic future, as well as giving the economy the much-needed boost it needs, we can start to avert further economic misery.
If we don?t, the long-term economic damage could be immeasurable. Lost capacity isn?t just economic jargon ? it?s real people?s jobs and workplaces, permanently destroyed by falling output and low growth. There are already close to 2.6 million people out of work, and many more without the hours they need to make ends meet.
We?re in too much of a mess to keep playing politics with people?s lives ? the Chancellor needs to admit he was wrong and act now to stop further damage.

HARTFORD, Conn. (AP) ? United Technologies Corp. said Wednesday that is selling three industrial-products businesses for $3.46 billion as it seeks to fund its proposed acquisition of aerospace-parts maker Goodrich Corp.
The three units of United Technologies' Hamilton Sundstrand division are being bought by private-equity firms BC Partners and The Carlyle Group.
United Technologies said proceeds from the sale will be used to repay some of the short-term debt needed to finance its $16.5 billion acquisition of Goodrich, which is based in Charlotte, N.C., and makes jet components such as landing wheels and brakes.
The sale of Milton Roy Co., Sullair Corp. and Sundyne Corp. is subject to regulatory approval and the deal is expected to close by the end of the year. United Technologies had announced earlier this year that it planned to sell the units, which make products ranging from rotary-screw compressors to high-speed centrifugal pumps.
United Technologies Corp. is also selling off other divisions, including its Rocketdyne engine-making unit and Clipper Windpower, as it focuses on its core aerospace and building-systems businesses.
Wednesday's announced sale "represents another significant step forward in our ongoing portfolio transformation," said United Technologies CEO Louis Chenevert.
The Hartford, Conn.-based company owns jet engine maker Pratt & Whitney, Otis elevator, Sikorsky Aircraft and other companies. Its shares rose $1.39, or 1.9 percent, to $74 in after-hours trading following the announcement the units' sale.

Researchers at the University of York are launching a major study of lymphoma and myeloma aimed at promoting earlier diagnosis and improving survival for patients with these cancers, which are among the most common in the UK.
The project, which is funded by Cancer Research UK as part of the National Awareness and Early Diagnosis Initiative (NAEDI), will develop an evidence base that could be used to reduce time-to-diagnosis in patients with these types of cancers.
Led by Dr Debra Howell of the Epidemiology and Genetics Unit in the University's Department of Health Sciences, the 300,000 study is prompted by data indicating that survival for many cancers is poorer in the UK than Europe.
Dr Howell says: "The UK Improving Outcomes Guidance for cancer considers that the most important reason for this is likely to be late stage diagnosis; earlier diagnosis may increase the scope for successful treatment and could save thousands of lives.
"There are nearly 15,000 new diagnoses annually of lymphoma (Hodgkin and non-Hodgkin) and myeloma in the UK, and early diagnosis is complicated by the complex nature of these diseases. The symptoms of lymphoma and myeloma can be strikingly similar to those of more common, benign conditions and this poses exacting challenges for both patients and GPs when identifying symptoms that may indicate malignancy. This situation often leads to delayed help-seeking and prevents early hospital referral."
Patients said:
"The doctors were concerned about these swollen glands in my neck which I'd had for a couple of months. I never thought anything about it because they didn't hurt."
"I just thought it was a swollen gland. It could have been an infection of the throat."
"I got the lump taken away and the doctor said I'm sorry to have to say that it's lymphoma. But prior to that I hadn't felt poorly. Nothing. I've had no symptoms. I've not been poorly at all really."
Despite UK Referral Guidance, data from the National Cancer Data Repository (2007) reported that patients with haematological malignancies, including lymphoma and myeloma, were generally more often diagnosed after emergency presentation and less often referred via the Government recommended two-week wait compared to those with other cancers.
The new study will include a cohort of around 1000 patients newly diagnosed with lymphoma or myeloma during 2012.
Its specific objectives are to:
The evidence generated will inform UK clinical guidance and could be used to develop tools such as computer-based decision programmes to help GPs to identify patients with these cancers. NEW YORK (AP) ? Boeing Co. surprised Wall Street with a 3 percent improvement in second-quarter net income Wednesday on strong sales of commercial airplanes. The company raised its earnings forecast for the year.
The results announced before the markets opened eased investors' fears of an imminent slowdown in the company's defense unit, which produces Chinook helicopters and F-18s among many other aircraft models. They also highlighted strong growth in the company's commercial airplane unit which has been rapidly increasing the pace of production for some planes to meet demand.
Boeing, based in Chicago, reported net income of $967 million, or $1.27 per share, for the April-June period compared with $941 million, or $1.25 per share, a year earlier.
Revenue jumped 21 percent to $20 billion from $16.54 billion a year ago.
Analysts polled by FactSet expected earnings of $1.13 per share on revenue of $19.28 billion.
Defense revenue rose 7 percent, while revenue in the commercial airplane division jumped 34 percent. The divisions are roughly the same size, but some observers fear they will go in opposite directions.
Boeing's defense unit is vulnerable to potentially severe military spending cuts in January. The cuts would be automatic unless Congress agrees to an alternative for cutting the deficit. The military would face $492 billion in cuts over a decade, with domestic spending reduced by another $492 billion over 10 years.
But it's clear the unit is still holding strong. The second-quarter revenue growth is about the same as Boeing saw in the first three months of the year. Defense contractor Lockheed Martin had reported second-quarter results that surprised Wall Street earlier.
Boeing's commercial airplane unit, meanwhile, is speeding production and deliveries of its new 787. That will move planes that have been mostly finished, but undelivered, out of inventory and turn them into cash. Boeing is also booking firm orders for its new 737 Max, a redesigned version of its classic 737.
Higher costs somewhat overshadowed strong results in both segments. Total expenses rose 30 percent in the spring quarter.
For all of 2012, Boeing Co. now expects to earn $4.40 to $4.60 per share, up from between $4.15 and $4.35. Still, that new forecast is mostly under what Wall Street is banking on. Analysts predict $4.57 per share, on average.
Boeing shares rose 95 cents to $72.98 in morning trading.
