Useful Tips For Selecting The Best Nursing Program

These days, nursing is one of the best fields you could enter. Why? One of the reasons is that so many other sectors are doing poorly. The global economy has still not recovered from the Great Recession of 2008, and there are signs that indicate that more difficult times may be ahead. But for students entering nursing school, there are hardly any signs of a recession.

The main reason for the incredible growth in the health care field is demographics. Put simply, world populations are aging. This is especially true in developed countries like the U.S., Canada, U.K., Australia, New Zealand, Japan, and most of Western Europe. In the U.S. alone, there are millions of Baby Boomers entering retirement, and they are expected to live longer than any previous generation. In fact, it is projected that many ?Boomers? will live well into their 90s.

The combination of the largest generation in U.S. history retiring at a time when medical technology has lengthened life expectancy far beyond what we could have imagined even a couple decades ago has created a need for health care professionals to tend to the medical needs of all these retirees. And a nursing program is the best way for most people to get a foot in the door of this lucrative field.

When it comes time to choose the right nursing school, there are a few questions to consider:

How soon do I want to be working?

One of the biggest considerations is your financial situation and how soon you need an income. If you need to be working right away, then becoming a CNA (certified nursing assistant) might be best. CNAs only have to train for a few weeks, then they are ready to enter the work force. And, the pay isn?t too bad either-you can earn around $15 an hour. Not great, but significantly higher than minimum wage.

What level of income do I want?

While CNAs can be working rather quickly, their pay is lower than that of an LPN or RN. It may be sufficient for those who are the second income earner in the house and don?t have a need to go for a higher pay scale, but for others, the LPN and eventually RN options pay much better. RN is obviously the best, but it takes longer to get through the schooling.

What level of responsibility can I handle?

With the higher pay of an RN comes greater responsibility, and often times longer hours working on salary. For those who are ambitious and want to eventually supervise LPNs, the RN option may be the best fit. But for those who don?t want the responsibility and lack the time and/or inclination to go the extra couple years of school, an LPN program may be just fine.

No matter which path you pick, your choices are not etched in stone. For example, a CNA can always go to LPN training part time, and an LPN can do the same working toward becoming an RN. Choose the option that?s best for your current circumstances, and you can always switch gears if your situation changes.

Bernard Madoff brother pleads guilty in Ponzi case

NEW YORK (Reuters) - Bernard Madoff's younger brother pleaded guilty to criminal charges that he helped advance the multibillion-dollar Ponzi scheme, but denied knowing about the epic, decades-long fraud.

With his guilty plea in Manhattan federal court on Friday, Peter Madoff is the first of Bernard Madoff's family members to admit criminal wrongdoing at the investment advisory firm.

"I truly believed that my brother was a brilliant securities trader," Peter Madoff told U.S. District Judge Laura Taylor Swain in a courtroom filled to capacity. "At no time did I suspect that my brother had stolen from anyone."

Peter Madoff, 66, had been chief compliance officer at Bernard L. Madoff Investment Securities LLC. He said Friday that he did not know the business was a sham until Bernard Madoff confessed to him in December 2008.

Dressed in a brown suit, Peter Madoff stood at the defense table and read for 15 minutes from typed notes, his voice breaking at times.

"I want to apologize to anyone who was harmed and to my family," Madoff said. He explained that he had always worshipped his brother, and was "shocked" when Bernard revealed that the firm, which had been the envy of Wall Street, had been a massive hoax all along.

Peter Madoff will be sentenced on October 4, and has agreed to accept a 10-year prison term. He was also ordered to forfeit a symbolic $143.1 billion and was released on a $5 million bond.

Bernard Madoff, 74, is serving a 150-year prison term and was ordered to forfeit $170.8 billion.

About a dozen people have been charged in connection with Madoff's Ponzi scheme. Manhattan U.S. Attorney Preet Bharara in a statement suggested that prosecutors may not be finished.

"Peter Madoff enabled the largest fraud in human history," Bharara said. "He will now be jailed well into old age, and he will forfeit virtually every penny he has. We are not yet finished calling to account everyone responsible for the epic fraud of Bernard Madoff and the epic pain of his many victims."

Prosecutors have not said whether they are preparing criminal cases against Bernard Madoff's son, Andrew, who was co-director of trading, or his niece, Shana, who was a compliance officer at the firm.

Five people implicated in criminal wrongdoing at Madoff's firm have pleaded not guilty.

Frank DiPascali, the firm's former chief financial officer, has been cooperating with the government since his plea nearly three years ago.

At Friday's court hearing, Peter Madoff, who had worked for his brother since 1965, said he had falsified papers for a series of money transfers, but claimed to have believed the money itself was legitimate. He also confessed to a litany of violations relating to maintaining the firm's books and records.

He said he had lied when certifying that he had conducted a thorough review of the firm's compliance with regulations.

"I made no effort to conduct a meaningful compliance review," he said.

A CHIEF ARCHITECT

The FBI called Peter Madoff one of the "chief architects" of his older brother's Ponzi scheme, which was uncovered when Bernard Madoff was arrested on December 11, 2008.

"Peter Madoff played an essential enabling role in the largest investment fraud in U.S. history," FBI Assistant Director Janice Fedarcyk said in a statement. "He made a pretense of compliance. He was really about complicity."

Peter Madoff was arrested at his lawyer's office on Friday morning, FBI spokesman Peter Donald said.

The U.S. Securities and Exchange Commission has also filed a lawsuit against Peter Madoff, the regulator said on Friday.

He still faces a lawsuit by Irving Picard, the trustee seeking money for victims of the Ponzi scheme, who has sued Peter Madoff and other family members for $255.3 million.

The trustee charges that the family members should have detected Bernard Madoff's Ponzi scheme at the firm that operated "as if it were their family piggy bank.

Picard sued Andrew Madoff; the estate of son Mark, co-director of trading who committed suicide in December 2010; and Shana Madoff.

Lawyers for Andrew and Shana Madoff did not immediately return calls seeking comment.

The trustee has described Peter Madoff as a savvy investor who was once vice chairman of the Financial Industry Regulatory Authority's board of governors.

Between 1998 and 2008, Peter Madoff received more than $40 million in salary and bonuses, federal prosecutor Lisa Baroni said in court on Friday. Picard has said the firm funded Peter Madoff's lavish lifestyle, including a $140,000 Ferrari and a home on Manhattan's upscale Park Avenue.

Picard has estimated customers of the Madoff firm lost about $20 billion. On Monday, the U.S. Supreme Court let stand a lower court ruling on the trustee's methods for calculating losses. That decision could help Picard repay customers faster.

The case is U.S. v. O'Hara et al, U.S. District Court, Southern District of New York, No. 10-cr-00228.

Scientists develop a spray-on battery

Scientists in the United States have developed a paint that can store and deliver electrical power just like a battery.?

Traditional lithium-ion batteries power most portable electronics. They are already pretty compact but limited to rectangular or cylindrical blocks.

Researchers at Rice University in Houston, Texas, have come up with a technique to break down each element of the traditional battery and incorporate it into a liquid that can be spray-painted in layers on virtually any surface.

"This means traditional packaging for batteries has given way to a much more flexible approach that allows all kinds of new design and integration possibilities for storage devices," said Pulickel Ajayan, who leads the team on the project.

The rechargeable battery is made from spray-painted layers, with each representing the components of a traditional battery: two current collectors, a cathode, an anode and a polymer separator in the middle.?

The paint layers were airbrushed onto ceramics, glass and stainless steel, and on diverse shapes such as the curved surface of a ceramic mug, to test how well they bond.

One limitation of the technology is in the use of difficult-to-handle liquid electrolytes and the need for a dry and oxygen-free environment when making the new device.?

The researchers are looking for components that would allow construction in the open air for a more efficient production process and greater commercial viability.

Neelam Singh, who worked on the project, believes the technology could be integrated with solar cells to give any surface a stand-alone energy capture and storage capability.

The researchers tested the device using nine bathroom tiles coated with the paint and connected to each other. When they were charged, the batteries powered a set of light-emitting diodes for six hours, providing a steady 2.4 volts.

The results of the study were published on Thursday in the journal Nature Scientific Reports.?

Lack of spring snow primed Colo. wildfires

Devastating wildfires scorching the state of Colorado are linked to a nasty streak of hot weather across the central part of the country, but it's tougher to link them definitively to global warming, climatologists say.

Earlier research has found broad trends linking earlier spring weather, rising temperatures and increased forest fires, suggesting that climate change may play a role in fires like the Waldo Canyon blaze outside of Colorado Springs, which has burned more than 18,000 acres and consumed about 300 homes here. But linking a specific fire to the long-term trend of global warming isn't possible.

"You can't say it's climate change just because it's an extreme condition," said Colorado state climatologist Nolan Doesken. So far, Doesken told LiveScience, the spring of 2012 looks much like the spring of 1910, when warm temperatures hit early. That year, he said, was a bad one for fires. The Waldo Canyon fire began on June 23 and has ripped through neighborhoods west of Colorado Springs, destroying a yet-unreleased number of homes. Just 130 miles to the north, the High Park wildfire outside of Fort Collins is well into its second week and has burned more than 87,000 acres. That fire killed one 62-year-old woman who was caught in her home.

Other significant fires in the state include a 300-acre blaze 1.5 miles outside of Boulder, a 9,168-acre blaze near Mancos in the southwestern part of the state and a 23,400-acre wildfire in rugged terrain in the San Juan National Forest, also in the southwestern part of the state.

The immediate driver of these fires is a lack of moisture and a ridge of heat that has settled over the central United States, said New Jersey state climatologist Dave Robinson, who also directs the Global Snow Lab at Rutgers University. After record snowpack last year, the Rocky Mountains did a 180 this year, Robinson said, seeing little moisture and early snowmelt.

"March and April are supposed to be your snowy months [in Colorado], and they weren't," Robinson told LiveScience. "Thus, the fire danger."

Meanwhile, a high-pressure system in the central part of the country is preventing cloud formation and allowing the sun to bake the ground, heating things up. On Tuesday (June 26) alone, 251 daily heat records were broken across the nation, according to the National Climatic Data Center. In the past week, more than 1,000 new daily heat records were put on the books. [The World's Weirdest Weather ]

Climate models predict that in a warming world, the West and Southwest will become drier and hotter ? conditions ripe for wildfires. Whether recent hot summers and active fires are a sign of the change already happening is still under debate, though.

"Some would say there is a pattern, because we have had several years with exceptionally large fires over western states, particularly the Southwestern states, Arizona, New Mexico, Texas and Colorado in particular," Doesken said. "Others would say, no, not enough data points yet to show that."

This year has been extreme in terms of heat and dryness, he said, as was 2002 (a record-breaking year for fires in Colorado). So far, 2012's weather looks very similar to the weather of 1910. That year, spring was warm and dry, which fed into a hellish fire season. Among the blazes was the Great Fire of 1910, also known as "the Big Burn," which destroyed 3 million acres of forest in Washington, Idaho and Montana.

Some studies do suggest that climate change is already affecting western wildfires. In 2006, researchers at the Scripps Institute of Oceanography in California analyzed 1,166 fires between 1970 and 2003 and found a dramatic increase in fire potency in the late 1980s. Though wildfire is a natural part of the western landscape, the researchers concluded that a warming climate was ramping up warm winters and springs, exacerbating natural fire cycles.

More recently, an analysis of 1,500 years of fire and tree-ring data revealed that a combination of climate change and human forest use could explain modern "megafires," the kind that destroy large swaths of forest. Fires were associated with a dry year following several wet years, because the moist periods allow undergrowth to spring up and provide fire fuel in dry years, researchers reported in May in the journal The Holocene. The study found that human activities such as livestock grazing and suppression of small fires compounded the problem, creating denser forests ripe for large blazes.

Earlier this month, Slate published an article by Sociologist Mark Regenerus about the effects of same sex parenting on children.? As part of the New Family Structures Study, Regenerus and his colleagues screened over 15,000 Americans (ages 18-39) and asked them if their biological mother or father ever had a romantic relationship with a member of the same sex. ? When comparing children who answered ?yes? to children from heterosexual married families, they found children from heterosexual married families fared better in economic, educational, social, and psychological outcomes.

This study has prompted many comments and several other articles.? For example, in another article in Slate, William Saletan says that the findings shouldn?t be surprising, as Regenerus?s study is not a study of gay parents who decided to have kids. ?Rather, it?s a study of people who engaged in same sex relationships (and often broke up their families) several decades ago.

?What the study shows, then, is that kids from broken homes headed by gay people develop the same problems as kids from broken homes headed by straight people. But that finding isn?t meaningless. It tells us something important: We need fewer broken homes among gays, just as we do among straights.

Sociologist Debra Umberson also shared reactions, published yesterday in the Huffington Post, to Regenerus?s study. ?Specifically, she focused on methodological concerns.

His definition of children raised by lesbian mothers and gay fathers is incredibly broad ? anyone whose biological or adopted mother or father had a same-sex relationship that the respondent knew about by age 18. Most of these respondents did not even live with their parent?s same-sex partner; in fact, many did not even live with their gay or lesbian parent at all! Of the 175 adult children Regnerus claims were raised by ?lesbian mothers,? only 40 actually lived with their mother and her same-sex partner for at least three years.

Umberson also notes that in order to be considered a child of a heterosexual married family, respondents had to have parents who were continually married from the time of their birth to the time of the survey.? With the wide net cast for same sex relationships, the study likely captured families that had far more stress than average families of that generation, contrasted with very stable heterosexual married families.

What does this tell us? ?According to both Saletan and Umberson, it?s a reminder that stress and instability harm children in any family context.

Cairn India down after Cairn Energy sells shares

MUMBAI: Shares of Cairn India dropped more than 6 per cent after two sources familiar with the matter told Reuters its UK parent sold part of its stake to a clutch of institutional investors at a discount.

Cairn sold about 66.8 million shares in the Indian unit, offering the shares at 307.40 to 317.50 rupees according to a term sheet seen by Reuters on Thursday, below its 327.35 rupee closing price that day.

Cairn India shares were last down 6.4 per cent at 306.40 rupees.

Citigroup was the book runner to the transaction, the sources said.

On Thursday, sources have told Reuters that the British oil explorer plans to sell about 3.5 per cent of its holding in the company.

Google now revamps search integration in Android 41 Jellybean

Google just officially unveiled its next iteration for Android -- Jelly Bean 4.1 -- and now we're getting to see the various "buttery" improvements the company's worked into the OS. Hugo Barra, Director of Product Management, took to the I/O 2012 stage to detail the refinements introduced to its search integration. The entire experience has been redesigned from the ground-up with a fresher UI and a "faster, more natural" voice search ability. That refreshed interface borrows from the recently outed Knowledge Graph, displaying queries for weather, Wikipedia and restaurants in graphical card format. That same layout extends to voice search, now spoken by a much more human-sounding voice. You can also dismiss the cards with a simple swipe, exposing the full list of search results beneath.

But that's not the whole story, the company's also introducing Google now -- a new form of search that ties your browsing and navigation histories together to anticipate your needs. In the demo, Barra showcased how the new system could help to calculate a user's commute, replete with alternate route suggestions and even scheduling info, recommend nearby restaurants as they're passed and keep users abreast of impending appointments with departure time recommendations. Excited for this next search-based step in Android? Then look for it to hit Galaxy Nexus, Nexus S and Xoom devices as part of the 4.1 update coming mid-July.

What this means is that business owners will now be able to enable their staff to use Square devices to accept payments without having to provide those employees with access to the same sensitive information that a business owner may see on their end. (AP) ? A European court on Wednesday upheld most of a massive fine levied against Microsoft by the European Commission's competition watchdog, closing a case against the software giant that began in 1998.

In an appeals ruling, the General Court of the European Union rejected Microsoft Corp.'s request to dismiss the fine levied in 2008, but did trim it by ?39 million to ?860 million ($1.1 billion). Counting two earlier fines, the case has wound up costing Microsoft a grand total of ?1.64 billion.

That's the most ever resulting from a single antitrust case in Europe, though in 2009 Intel Corp. was hit with the largest single fine, ?1.09 billion.

The court in Luxembourg said its decision "essentially upholds the Commission's decision and rejects all the arguments put forward by Microsoft in support of annulment."

The ?860 million fine is a "penalty for noncompliance" with the watchdog's 2004 order for Microsoft to make computer programming code available that would allow competitors' products to interface properly with Microsoft's server software.

Microsoft did so, but at a price the Commission said was so exorbitant it amounted to not complying.

The court upheld that finding, but said Microsoft deserved a small break because of a letter the Commission sent in 2005 saying the company didn't have to freely distribute code that wasn't its own and was freely available elsewhere. That letter gave Microsoft some room to think it was okay to continue acting the way it had until 2004, and should have been "taken into account in determining the gravity of the conduct found to be unlawful," the written decision said.

The Commission's top regulator Joaquin Almunia said the judgment "fully vindicates" his office's action against Microsoft and "brought significant benefits to users."

"A range of innovative products that would otherwise not have seen the light of day were introduced on the market," thanks to the Commission, he said.

Microsoft was less enthusiastic.

"Although the General Court slightly reduced the fine, we are disappointed with the Court's ruling," the company said in a statement.

Microsoft was initially fined ?497 million along with the 2004 order, then it was penalized another ?280.5 million for noncompliance in 2006, and then another ?899 million in 2008.

The company has already booked provisions for all the fines and penalties and after the ruling it has no active outstanding quarrels with European regulators.

"In 2009 Microsoft entered into a broad understanding with the Commission that resolved its competition law concerns," the company said.

Most notably in the 2009 deal, Microsoft ended an investigation into allegedly abusive practices for bundling its Internet Explorer web browser along with its operating systems. Microsoft agreed to instead offer customers a range of browsers to choose from.

In a sign of the times, Microsoft itself turned to the watchdog in 2012, asking it to investigate Google Inc. for anticompetitive practices. Microsoft alleged that Google was demanding unreasonable fees to license its technologies and asking courts to pull Microsoft products from shelves if they don't pay up. Google shot back with a similar request for the Commission to again investigate Microsoft last month.

Many observers say companies such as Apple Inc., Google and Microsoft are increasingly acting as "patent trolls," using the legal and regulatory systems as tools to thwart competitors as part of their wider struggle for market share.

Almunia said in February "the Commission will continue to keep a close eye on the behavior of all market players in the sector, particularly the increasingly strategic use of patents."

Google Makes Its Play in Tablets

Google launched its Nexus 7 tablet on Wednesday at its Google I/O developers conference in San Francisco. The tablet, which is made by Asus, has an 1,280 by 800 display. It has an Nvidia Tegra 3 quad-core CPU with that processor's associated 12-core GPU. The Nexus tablet 7 has a front-facing camera and supports WiFi, Bluetooth and near-field communications.

Colorado wildfire worsens, forcing 7,000 more from homes

COLORADO SPRINGS (Reuters) - A monster Colorado wildfire raging near some of the most visited tourist areas in the state took a turn for the worse on Tuesday as hot winds pushed flames north, prompting the evacuation of 7,000 more people, officials said.

Colorado's so-called Waldo Canyon fire sent a mushroom cloud of smoke nearly 20,000 feet into the air over Colorado Springs near Pikes Peak, whose breathtaking vistas from the summit helped inspire the song "America the Beautiful".

Closer to the blaze, which has been fanned by winds blowing into the Southern Rockies from the prairies to the east, trees were visibly twisting from the heat of the flames.

The latest evacuations brought the total number of people forced from their homes to about 12,000 as the blaze posed a renewed threat to hundreds of dwellings and appeared to have roared to within about a mile of the U.S. Air Force Academy grounds in Colorado Springs.

Operators of a famous cog railway that carries tourists up to Pikes Peak said the trains would remain shut down on Tuesday for a third straight day.

The highway that leads up to Pikes Peak has been closed since shortly after the fire erupted on Saturday, as has the popular Garden of the Gods, a picturesque park of tall, rocky spires and oddly balanced boulders.

Air tankers dropped fire retardant in the blaze's path to slow its advance, while firefighters on the ground battled to protect homes along a highway at the mountain's edge, including the upscale, gated community of Cedar Heights. No homes were reported burned, but the fire consumed a wooden tent platform.

"We're feeling pretty good that's the only thing we've lost given this monster we are dealing with," said Rob Deyerberg, a fire information officer.

The closures around Pikes Peak, billed as the world's second-most visited mountain after Japan's Mount Fuji, have drawn attention to the fire's negative impact on the tourism industry just at the start of the peak summer travel season.

After three days, the blaze has scorched an estimated 4,500 acres, and fire crews managed to carve containment lines around just 5 percent of its perimeter. The cause was still under investigation.

A recreation area belonging to the Air Force Academy was ordered evacuated due to its proximity to the fire, and all trails leading west of the school were closed, the base said.

'TRYING TO REMAIN OPTIMISTIC'

Despite the fresh evacuations, the town of Manitou Springs, which had been evacuated over the weekend, appeared to remain out of imminent danger after residents were allowed back on Sunday.

Pam Staley, 60, a Colorado Springs resident, said she was concerned about the health effects of thick smoke and soot on many of her elderly neighbors who live in older homes without air conditioning.

"They sleep with open windows, and when the wind shifts, in the middle of the night, they get sick," she said as she stood watching the blaze from a safe distance at a local high school. Their eyes are watering, they're coughing. I'm really, really worried about them."

The wildfire was one of about a dozen burning out of control around Colorado, including the much larger High Park Fire near Fort Collins, a university town north of Denver close to the Wyoming border.

"We're going to be continuing to have to deal with these fires for weeks to come," U.S. Forest Service Chief Tom Tidwell said. "We anticipate it's going to be a long fire season."

To the east of the Waldo Canyon blaze, a fast-moving prairie fire apparently sparked by a blowout on a passing vehicle torched 45,000 acres of grassland and ripped through the town of Last Chance, population 25.

The blaze destroyed 11 buildings including four homes before being contained.

The High Park Fire - the state's second-largest blaze on record and its most destructive ever - has consumed 87,250 acres in steep canyons since it was sparked by lightning two weeks ago. It is blamed for the death of a 62-year-old woman in her cabin and has destroyed 248 homes.

An estimated 4,300 people remain evacuated from their homes as that fire burns through grass, brush and Ponderosa pine.

In southwestern Colorado, the Weber Fire grew to 8,930 acres but firefighters held it back from the small town of Mancos, east of Mesa Verde National Park. Roughly 50 homes were evacuated, officials said.

Farther to the west, authorities said a body was found in the ashes of a house charred by Utah's fast-moving Wood Hollow Fire, marking the first fatality in a blaze that already has scorched more than 39,000 acres. Fresh evacuations were ordered there on Tuesday.

The Wood Hollow blaze had already burned an estimated 30 homes and killed 75 sheep between the rural communities of Fountain Green and Indianola.

Governor Gary Herbert, who toured the fire by helicopter on Monday, estimated the property losses so far at $7 million. No injuries have been reported, but Herbert said fire officials did use a helicopter to rescue some shepherds from the fire's path.

(AP) ? The Supreme Court on Monday turned away a plea to revisit its 2-year-old campaign finance decision in the Citizens United case and instead struck down a Montana law limiting corporate campaign spending.

The same five conservative justices in the Citizens United majority that freed corporations and labor unions to spend unlimited amounts in federal elections joined Monday to reverse a Montana court ruling upholding the state's century-old law. The four liberal justices dissented.

"The question presented in this case is whether the holding of Citizens United applies to the Montana state law. There can be no serious doubt that it does," the court said in an unsigned opinion.

The Citizens United decision paved the way for unlimited spending by corporations and labor unions in elections for Congress and the president, as long as the dollars are independent of the campaigns they are intended to help. The decision, grounded in the freedom of speech, appeared to apply equally to state contests.

But Montana aggressively defended its 1912 law against a challenge from corporations seeking to be free of spending limits, and the state Supreme Court sided with the state. The state court said a history of corruption showed the need for the limits, even as Justice Anthony Kennedy declared in his Citizens United opinion that independent expenditures by corporations "do not give rise to corruption or the appearance of corruption."

In a brief dissent Monday, Justice Stephen Breyer said campaign spending since 2010 "casts grave doubt on the court's supposition that independent expenditures do not corrupt or appear to do so."

State leaders in Montana swiftly condemned the decision.

Montana Attorney General Steve Bullock called the nation's high court just "another political body," while Gov. Brian Schweitzer says the Supreme Court is now endorsing "dirty, secret, corporate, foreign money."

Twenty-two states and the District of Columbia, as well as Sen. John McCain and other congressional champions of stricter regulations on campaign money, joined with Montana.

New York Attorney General Eric Schneiderman said Monday's "decision gives short shrift to states' vital interests in protecting their democratic processes and institutions from the threats posed by unlimited corporate spending in campaigns."

James Bopp, the lawyer who challenged the Montana law, said," This closes the door on the argument that unique facts in a certain state can be employed to overturn Citizens United."

In February, Breyer and Justice Ruth Bader Ginsburg, both dissenters in Citizens United, challenged Kennedy's view that the independent campaign spending could not be corrupting by virtue of the absence of links to a campaign.

When the court blocked the Montana ruling in February, Ginsburg issued a brief statement for herself and Breyer saying that campaign spending since the decision makes "it exceedingly difficult to maintain that independent expenditures by corporations 'do not give rise to corruption or the appearance of corruption.'"

Ginsburg appeared to be referring to the rise of unregulated super PACs that have injected millions of dollars into the presidential and other campaigns. She said the case "will give the court an opportunity to consider whether, in light of the huge sums currently deployed to buy candidates' allegiance, Citizens United should continue to hold sway."

The corporations that sued over the law said it could not remain on the books after the Citizens United decision.

Montana urged the high court to reject the appeal, or hold arguments. The state would have preferred either of those outcomes to what the court did Monday ? that is, issue what the court calls a summary reversal without holding new oral arguments. The prevailing side in the lower court almost always strives to avoid high court review. But Montana and its supporters hoped a thorough debate over the Citizens United decision would lead to its reconsideration or at least limits on its reach.

The case is American Tradition Partnership v. Bullock, 11-1179.

Thome to the rescue

PHILADELPHIA (AP) - Jim Thome knows the routine. Hit a game-ending homer, circle the bases, get mobbed by teammates.

It never gets old.

Thome hit a pinch home run leading off the bottom of the ninth inning to lift the Philadelphia Phillies over the Tampa Bay Rays 7-6 on Saturday after Jonathan Papelbon blew his first save in 18 chances this season.

Thome connected off Jake McGee (2-2) for home run No. 609, tying Sammy Sosa for seventh place on baseball's career list. It was the 13th time he did it to end a game.

"You never forget them," Thome said. "These are moments you never know how long you'll have them."

Juan Pierre and Jimmy Rollins also homered for the Phillies, helping manager Charlie Manuel earn his 900th career win.

"To do that for him, it was special for sure," said Thome, who is very close to Manuel.

In the first meeting at Citizens Bank Park between this teams since Philadelphia won the 2008 World Series, the Phillies rallied from a 3-0 deficit against James Shields with homers from their Nos. 1-2 hitters. But Papelbon couldn't hold the lead.

Thome then came through to lead the five-time defending NL East champions out of last place for the first time since May 4. He hit a high drive to left field, jogged around the bases to a rousing ovation and got a cream pie in the face from Shane Victorino afterward on the field.

"That felt great," Thome said. "They put whipped cream instead of shaving cream so that was nice."

Tampa Bay's Jeff Keppinger was 5 for 5 with three RBIs in his first game after he missed 29 because of a broken toe.

Papelbon (2-2) allowed his first earned runs in a save situation this season. He walked Jose Lobaton with two outs to extend the game. Keppinger followed with an RBI single. Then, Brooks Conrad ripped a run-scoring single to right to tie it. Conrad was 3 for 41 before that hit.

"I've got to do a better job," Papelbon said.

Papelbon said he told Thome in the on-deck circle that he would give him $5,000 if he hit a homer. Papelbon said he wrote the check in the clubhouse.

"That was a huge pickup by Jim Thome," Papelbon said. "I couldn't be happier for anybody in the clubhouse."

Shields, who beat the Phillies in Game 2 of the `08 Series for Tampa Bay's only win, allowed five runs and seven hits in five innings. Since starting 5-0, Shields is 2-4 with a 4.69 ERA.

Tampa Bay has lost three straight.

"Tip your hat to Thome. He hit a 96 mph fastball off a left-hander and they beat us," Rays manager Joe Maddon said.

The 41-year-old Thome was 0 for 12 as a pinch-hitter before his at-bat. He batted .333 with four homers and 14 RBIs in nine games as a designated hitter during interleague play earlier this month.

Shields fanned the first two batters in the fourth before getting in trouble. Pinch-hitter Mike Fontenot and Rollins hit consecutive singles. That brought up Pierre, who hadn't gone deep in 366 at-bats, dating to Aug. 16 with the Chicago White Sox. Pierre lined career homer No. 17 over the right-field fence, and strutted down the line with a finger pointed in the air.

Pierre reached on a two-base error, hustling his way to second base in the seventh. Carlos Ruiz looped an RBI single to right off Brandon Gomes to make it 6-3.

The Rays loaded the bases with no outs in the eighth against Antonio Bastardo, but only got one run on an RBI single by Sean Rodriguez.

Kendrick got Philadelphia started in the third with a leadoff walk. Rollins followed with a drive that hooked inside the right-field foul line to cut the deficit to 3-2. The Phillies had runners on first and third with one out, but couldn't push across the tying run. Ty Wigginton struck out and Placido Polanco flied out.

Kendrick allowed three runs and six hits in four innings, striking out six. He is 1-3 with a 7.36 ERA in five starts since shutting out St. Louis on May 26.

Kendrick retired the first four batters before unraveling with one out in the second. He allowed a single to Ben Zobrist and walked Lobaton. Keppinger followed with a two-run double down the left-field line. He advanced to third on a throwing error by second baseman Michael Martinez and scored on Shields' groundout for a 3-0 Rays lead.

Notes: Pierre was 2 for 4 with three RBIs, two runs and two stolen bases. He also made a sliding catch in left field. ... Phillies RHP Mike Stutes will have arthroscopic surgery on his right shoulder on Tuesday. Dr. Lewis Yocum will perform the operation. ... Rays RHP Todd Farnsworth (right elbow strain) is scheduled to make his first back-to-back rehab appearances on Sunday and Monday. ... Shields struck out seven. ... Ruiz was hit by a pitch for the major league-leading 12th time. ... The Phillies had their 255th straight sellout, including postseason play. ... The Phillies will send Cole Hamels (10-3, 3.25) and Cliff Lee (0-3, 3.48) to the mound in their day/night doubleheader Sunday. David Price (9-4, 3.08) will pitch the first game for Tampa Bay. The Game 2 starter is undecided.
